Commencement of the Administration of Muslim Law (Amendment) Act 2022

On 14 February 2022, amendments were made to the Administration of Muslim Law Act 1966 (AMLA) vide the Administration of Muslim Law (Amendment) Act 2022 (“Amendment Act”).

Pursuant to a Commencement Notification gazetted on 29 November 2022, the following provisions of the Amendment Act come into operation on 30 November 2022: Sections 2(f), 3, 8 to 11, 21, 22, 23, 25, 28 and 29.

Muslim Marriage and Divorce (Amendment No. 2) Rules 2022

The Muslim Marriage and Divorce (Amendment No. 2) Rules 2022 (“Amendment Rules”) was published on 29 October 2022 and comes into operation on 30 November 2022. The amendments include the insertion of a new Part IIIA Electronic System and new provisions on:

  1. service of certain documents on person under disability;
  2. continuation of hearing by another president of the Court; and
  3. stay of enforcement.

Under the Amendment Rules, it is also no longer a requirement for the plaintiff to serve the Agreed Matrimonial Property Plan on HDB and for HDB to provide its written reply.
